This Policy sets out the general rules governing the collection of personal data by PAKISNOVA through its web pages, sites and / or applications through which personal data may be collected (hereinafter "Mobile Application").

1. Application and Introduction

1.1. This Privacy Policy of the Company applies to personal information collection and use while you: (1) visit Fauricash’s Mobile Application; (2) install, activate and use Fauricash’s Mobile Application, the system registers You as a user on the Fauricash’s Mobile Application; (3) when You register as a user on the Fauricash website/app, or when you apply the service of Fauricash through its website/app.

1.2. You must agree to and be willing to accept the terms of this Policy before you may visit or use any Fauricash Mobile Application, or any products or services offered therein. If you do not agree with this Policy or any part of it, please do not use or access our Mobile Application or any part of it.

1.3. By affirming your assent to this Privacy Policy, you consent to such collection, use, storage, processing and disclosure as set forth in this Privacy Policy and the Terms and Conditions. This Privacy Policy is subject to change at any time without notice. You are responsible for regularly reviewing this Privacy Policy to be aware of any changes.

1.4. This Policy and any additional terms of use apply to you even if you are not our customer and you interact with us as part of running our business, such as by:

1. accessing any of our products or services accessible through any Fauricash Mobile Application;
2. when using any of our products or services;
3. when entering any promotion;
4. when using our customer service;
5. generally enquiring about Our services or products.

1.5. You guarantee that in the event you provide any personal data of third parties (e.g. guarantors, Reference Contact’s Number), you have notified the third parties and obtained valid consent from such third parties, or you have legitimate interest to provide their personal data to Fauricash, to the extent necessary for Fauricash to process their personal data for purpose as stated in this Privacy Policy. You shall also help and assist Fauricash to obtain valid consent from such third parties. Therefore, in the event that You provide personal data of third parties, Fauricash assumes that You have had their consent or you have the necessary legitimacy to do so and that the third party has been informed of the information contained herein.

1.6 People under the age of eighteen(18) years old must not register on any of Our Mobile Application.(s).

1.7. Authorization to consult and report central risk and information centers

 

You hereby declare and warrant that the information You have provided is true and You authorize the Company to collect, collect, store, use, circulate, suppress, process, compile, treat, update and dispose of your credit, financial and commercial information with any natural and/or legal person that operates national and/or international databases: in order to determine Your indebtedness capacity, credit risk and possibility of being subject to credit

1. Consult, at any time, in the credit bureaus all relevant information to know Your performance as a debtor, Your payment capacity or to assess the future risk of granting me a credit and/or any other financial service;
2. Report in the credit bureaus. directly or through the public entities that exercise oversight and control functions, processed or unprocessed data related to:

• Timely fulfillment and non-fulfillment of Your credit obligations, constitutional and legal duties of patrimonial content, in such a way that these present truthful, pertinent, complete, updated and accurate information of Your performance as debtor after having crossed and processed diverse useful data to obtain meaningful information;
• Your credit applications, as well as others related to Your commercial, financial and general socioeconomic relationships that I have submitted or that are recorded in public records, databases or public documents;

 

2.What type of personal data do we process

2.1.“Personal information” means any information that can be used to identify, locate, or contact an individual, alone or when combined with other personal or identifying information, such as personal information that you provide when you register and create an Account with Us, which includes but is not limited to your name, e-mail address, phone/mobile number, country/city, email address; job status, company name, salary, payday, marital status, family address, SIM card, age, gender, username, password. The PAKISNOVA may associate any category of information with any other category of information and will treat the combined information as personal data in accordance with this Policy for as long as it is combined.

All data will be uploaded and stored on our server in an encrypted form through the interface, but the Company will not disclosed the data to any third parties without authorization or beyond the scope of providing service to You.

2.2. We collect information when You register with us via any PAKISNOVA Mobile Application, including information and data provided by You when filling in the registration information form on any Fauricash Mobile Application, and information and data provided in the course of any correspondence with us (for example, by e-mail or chat or helpline).

2.3.We may collect information when you install or uninstall the Fauricash Mobile Application to avail any products or services. Such product or service may contain a unique application number or when such a product or service searches for automatic updates, that number and information about your installation, for example, the type of operating system, may be sent to us.

2.4. We collect information and data you provide when you register to use any products or services via any Fauricash Mobile Application, download or register the same, subscribe to any of our services (such as applying for a loan), search for any product, service or application, enter a promotion or survey, and when you report a problem with an application, our services, or any of our Fauricash Mobile Application.

2.5. We may also collect your information from outside sources and third-party service provider, like banks, Credit Bureau (credit report) and commercially available geographic and demographic information (third-party supplied information).

2.6. PAKISNOVA and its authorized third-parties may also collect, store and process personal information such as password, financial information (details of bank account, credit card, debit card, or other payment instrument details), physiological information for providing our products, services and for use of our Fauricash Mobile Applications.

2.7. Means of obtaining and updating

Personal data will be obtained and updated through means:

(1)Remote or electronic;

(2)Through the use of other technologies that allow data to be collected automatically or simultaneously at the time the data subject contacts PAKISNOVA.

2.8. When you use Our Mobile Application, whether our Website or our App, we collect and store your information (personal information) which is provided by you from time to time by explicitly seeking permissions from You to get the required information.

Including but not limited to, a User’s Internet Protocol (IP) address, operating system, browser type, and internet service provider. This type of information does not identify the visitor or customer personally.

Including the type of mobile device you use, unique device identifiers (for example, your device's IMEI or serial number), information about the SIM card used by the device, mobile network information, your device operating system, the type of browser you use, or your device's location and time zone setting (device information).

Details of your use of any of your applications or your visits to any of Fauricash Mobile Applications or websites including, but not limited to traffic data, location data, weblogs and other communication data.

Fauricash/ PAKISNOVA may also use GPS technology or other location services to determine your current location.

1. Installed Application

Fauricash / PAKISNOVA Collect and monitor specific information about your installed application on the app. We will upload it encrypted to our server in order to identify and analyze your behavior and risk against multiple loans to assess whether it can be processed the loan or not and help prevent fraud.

1. Access to Calendar

We require the Calendar access permission in order to allow us to remind you for timely payment during the loan repayment period. This facility is to improve the repayment procedure and your experience. If you do not enable this permission, you will not use the specific part related to this permission. However, it will not affect your use of other essential services.

Images and Files

We also collects User’s CNIC (ID Card) image and live photo that are self generated by Fauricash. We will upload this information encrypted to our server.

In any case, these entities will also be subject to the confidentiality obligations in the handling of the information with the legal limitations imposed by the applicable laws on the matter in the jurisdiction where it is collected, filed, processed, or transmitted.

2.9. You agree that Fauricash / PAKISNOVA may collect, store and process all of the information mentioned above, which we may collect as part of your interaction with Fauricash, including third-party supplied information. By using any Fauricash Mobile Application, You hereby agree and consent to the collection, storage, and use of the personal data for any of the products or services that we offer, and consent to our collection of any changes or updates to such information.

 

3. For what purpose do we process your personal data and on what basis do we do so?

3.1. Purposes based on the execution of a contract in which the interested party is a party or to carry out procedures at the request of the interested party prior to entering into a contract with PAKISNOVA:

Know your customer process (KYC), including, without limitation, the identification of your identity, the fight against fraud, money laundering and terrorist financing.

Evaluate your credit (including automated decision making), manage your loan application, grant loans and execute the contract with you.

Debt recovery and the related payment process, including without limitation contact with you (by us, our authorized organization, or any individual or legal entity purchasing debt from us) in the event of a debt default.

Follow your instructions in relation to the products and services contracted by you and to verify the transactions on any of your products and services.

3.2. Purposes based on your consent when registering on any of our Mobile Application.

Sending commercial communications electronically

Manage your participation in the different promotional actions (raffles, contests, coupon etc.) organized by PAKISNOVA

Respond to requests and messages sent by You.

3.3. Purposes based on compliance with current laws.

Prevent fraud, money laundering and verify customer transactions related to service and product We provide to you.

 

4. Tracking and Cookies

4.1. "Cookies" are small text files transferred by a web server to users’ hard drive and thereafter stored on their computer. The types of information a cookie collects include the date and time users visited, their browsing history, preferences, and username.

4.2. Fauricash may use Cookies to manage our users’ sessions and to store preferences, tracking information, and language selection. Cookies may be used whether You register with us or not.

4.3.In some instances, our third-party service providers may use cookies on the website or other Fauricash Mobile Application. We cannot control or access cookies used by third- party service providers. This Policy covers only Cookies used by us, and not any Cookies used by third parties.

4.4. You may have the ability to either accept or decline the use of Cookies on your computer, whether registered with us or not. Typically, you can configure your browser to not accept Cookies. However, declining the use of Cookies may limit your access to certain features of the website and /or Fauricash Mobile Application. Cookies helps us to provide you with a good experience when you use the Fauricash Mobile Application or browse any of the websites and also allows us to improve the Fauricash Service.

4.5. You can withdraw your consent for further collection of this information at any time by logging out and uninstalling the Fauricash mobile or other applications from your device.

 

5. How we use Your personal information

5.1. Information collected by us shall be used for the purpose of determining whether or not to provide a financial service or product to the customer, the amount of such exposure and the terms and conditions applicable to such services or product.

5.2.We may also use a third-party payments services provider or payments processing company to process payments and repayments, transfer money to your Operative Account or any other user account, process other payments, and to provide additional products and services, and may therefore disclose your information to such third-party payments services provider.

5.3. We use your information to power our services and to improve your experiences and interaction with PAKISNOVA. We use your information to provide, support, improve, protect, analyze and bill for our products and services; to communicate with you about your service, products or applications; to market our products and services; to detect and avoid fraud; for advertising; and for research purposes. We may use information we collect from you when you purchase a product or service from us, sign up for our newsletter, respond to a survey or marketing communication, surf the website or Fauricash application, if you register for an online account with us, download and register on one of our apps or use certain other site features in the following ways:

2. improve our website/app in order to better serve you;

5.7.We may disclose your personal information to any local or international law enforcement officers or competent regulatory or governmental agencies, in good faith belief that such disclosure is reasonably necessary to enforce any terms and conditions and/or this Policy, to assist in the prevention, detection, investigation or prosecution of criminal activities or fraud.

5.8.We shall use your data for the purposes of compiling statistic relating to our user base or financial product or services and may disclose such information to any third party for such purposes, provided that such information will always be anonymous.

5.9.We may use other third-party companies to monitor site traffic, which may, in some instances, store customer information. Where we use another organization, we still control your personal information and we have strict controls in place to make sure it’s properly protected.

6.5.Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Fauricash Mobile Application, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, but we cannot guarantee the security of your data transmitted to our Fauricash Mobile Application; any transmission is at your own risk. Once we have received your information, we will use procedures and security features to try to prevent unauthorized access, to the extent reasonably practical.

6.6.You agree that PAKISNOVA or any of its affiliates, associated or related entities, employees, directors, shareholders, agents, representatives etc. shall have no liability towards you in case of any unintended security breach which results in unauthorized access to, or disclosure of, your information. You agree to waive, to the fullest extent permitted by law, all of your rights to seek damages or otherwise hold PAKISNOVA and its related entities liable for any security breach resulting in disclosure or unauthorized access to your information.

 

7.Marketing

We may contact you periodically by e-mail to provide information regarding our products, services and content that may be of interest to you. If applicable law requires that we receive your consent before we send you certain types of marketing communications, we will only send you those types of communications after receiving your consent.

 

8.Disputes

This Agreement shall be governed by and construed in all respects under the laws of Islamic Republic of Pakistan. Any disputes regarding this Policy shall be subject to the Terms and Conditions of Fauricash/ PAKISNOVA, including but not limited to any provisions related to indemnification, limitation of liability relating to damages, choice of law and dispute resolution forum. We ask you to first submit any such complaints directly to us the relevant customer services email.
